Madras High Court Bars TVK MLA from Trust Vote Over Dual Tirupattur Confusion

The Madras High Court has temporarily barred Tamilaga Vettri Kazhagam (TVK) MLA Seenivasa Sethupathy from participating in the crucial trust vote scheduled in the Tamil Nadu Legislative Assembly. The interim order was passed by a division bench comprising Justices L. Victoria Gowri and N. Senthilkumar on Thursday, sending ripples through the state's political circles.

The order came in response to a writ petition filed by former DMK Minister K.R. Periakaruppan, who lost to Seenivasa Sethupathy by a mere single vote in the recent assembly elections. Periakaruppan's petition highlighted a unique and unprecedented confusion that allegedly affected the election results - the existence of two constituencies bearing the identical name 'Tirupattur' in Tamil Nadu.

According to sources, Periakaruppan argued before the court that the similarity in constituency names led to significant voter confusion and administrative complications during the electoral process. He contended that voters in one Tirupattur constituency may have inadvertently cast their votes intended for the other, thereby affecting the final tally. Given the wafer-thin margin of just one vote that separated him from victory, the former minister claimed this confusion directly impacted the election outcome.

The bench, after hearing preliminary arguments, found merit in examining the issue further and passed interim orders restraining the TVK MLA from taking part in the trust vote until the matter is heard in detail. The court has scheduled the case for further hearing, indicating that it would examine the constitutional and electoral implications of having two constituencies with identical names.

This development has significant political ramifications as the trust vote is a critical constitutional exercise that determines the stability of the government. The temporary exclusion of one MLA could potentially alter the arithmetic in the assembly, especially in a closely contested political scenario.
