High Court asks lower courts not to order attachment of trains

The high court has directed the executive courts across the state not to pass an order to attach or confiscate the railway engine, bogie or any such equipment which are in motion.

Justice AS Bopanna passed this direction while hearing a petition filed by the South Western Railway wherein they had challenged the February 4, 2016, order passed by the Principal Civil Judge, Chitradurga, directing the authorities to seize a train citing the failure of the railways to compensate people whose lands were acquired for a project.

However, the courts can issue orders for recovery of other railway properties like office equipment, furniture etc. SWR had complained about the manner in which the courts have been issuing warrants to attach engines which are in service, causing disruption of the service of other trains and inconveniencing passengers.
