The Supreme Court has suspended the 3-year imprisonment sentence of former Tamil Nadu Higher Education Minister K Ponmudi in a disproportionate assets case, without addressing the plea to suspend the conviction.
Coimbatore: On March 11, 2024, the Supreme Court provided temporary relief to K Ponmudi, the former Tamil Nadu Higher Education Minister, by suspending his 3-year sentence related to a disproportionate assets case. The decision was announced by a bench consisting of Justices Abhay S Oka and Ujjal Bhuyan, who stated that Ponmudi is to be released on bail under specific terms and conditions set by the Special Court.
The court ordered Ponmudi to present himself before the Special Court and fulfill the bail requirements within a one-month timeframe. Until these obligations are met, he is exempt from surrendering, as per the interim order.
Clarification was sought by Senior Advocate Siddharth Luthra, representing Ponmudi, regarding whether the sentence was being suspended but not the conviction. Justice Oka confirmed that the suspension pertained to the sentence alone, indicating that the appeal against the conviction had not been considered at this stage.
This court action follows a legal challenge by Ponmudi against a Madras High Court decision that overturned his initial acquittal in the disproportionate assets case. The accusations against him and his wife stemmed from their alleged accumulation of wealth disproportionate to their known sources of income during his tenure as Minister for Mines and Minerals in the DMK government from 2006 to 2010.
Although the Trial Court initially acquitted them, citing a lack of evidence to prove the disproportionate wealth of Rs. 1.36 crores, this verdict was reversed by the Madras High Court in December 2023. The High Court found faults in the Trial Court's judgment and sentenced Ponmudi and his wife to three years of simple imprisonment, along with a fine.
By appealing to the Supreme Court, Ponmudi sought to contest the High Court's decision to reverse his acquittal. With today's ruling, his sentence has been suspended while the appeal is being considered, offering him a temporary respite as the legal proceedings continue.
