Madras High Court Refuses to Quash Proceedings Against TN BJP President K. Annamalai

Chennai: The Madras High Court, on Thursday, declined to quash criminal proceedings against BJP Tamil Nadu president K. Annamalai, emphasizing the potential threat to India's secular constitution due to his remarks aimed at creating religious discord. Justice N. Anand Venkatesh highlighted the prima facie intent to instigate hatred towards a particular religion, based on Annamalai's statements during a YouTube channel interview before Deepavali in 2022.

The court's refusal stemmed from Annamalai's claim attributing the first legal challenge against the bursting of crackers to a Christian missionary NGO. This assertion was deemed to have a divisive intent, projecting the NGO's actions as an attack on Hindu culture. The focus was on a specific six-and-a-half-minute clip from the interview, disseminated by the BJP's Tamil Nadu unit, which the judge found indicative of an attempt to undermine Hindu traditions through international funding and legal battles.

Justice Venkatesh's ruling delved into the historical context of hate speech, tracing back to the offence of De Scandalis Magnatum in 1275, and underscored the heightened relevance of such speech in today's social media age. He referenced a Supreme Court warning about the latent dangers of hate speeches, likening them to a "ticking bomb."

The psychological impact of statements made by influential leaders was a key concern, with the court considering the potential for silent harm to the psyche of targeted groups. Justice Venkatesh invoked the historical consequence of hate speech, notably the genocide of Jews under Adolf Hitler, to illustrate the catastrophic outcomes of unchecked religious fervor and hate speech.

In his analysis, Justice Venkatesh also reflected on the fundamental understanding of religion, cautioning against its misuse as a tool for division or violence. He cited Karl Marx's critique of religion as "the opium of the people" to emphasize the importance of a genuine comprehension of religious purpose.

The court concurred with the advocate representing the complainant, acknowledging the reasoned order of a Judicial Magistrate in Salem that had initially taken cognizance of the complaint. While the proceedings will continue, the judge affirmed that Annamalai could present his defense during the trial.

Justice Venkatesh concluded his order with a reference to the Supreme Court's portrayal of Hinduism's heterogeneity, underscoring the religion's historical adaptability and inclusiveness. This case serves as a reminder of the judiciary's role in safeguarding the constitutional and secular values of India amidst challenges posed by divisive rhetoric.
