Neglected father finally gets justice

An 85-year-old man from Vilankurichi had in 2006 distributed his property worth 18 crore among his three sons equally, with the condition that they give him 10,000 each month to cover his medical expenses. When they refused to pay heed to his request, the father went to court in 2008.

On Thursday evening, the family court here ordered the three sons to pay 21,000 (each 7,000) per month within the first ten days of the month to their father. In addition, they should pay their father 2.52lakh for each year between 2008 and 2015.

S Shanmugasundaram, 85 and his wife S Sivakamiyammal, 75 reside at Poo Thottam in Vilankurichi. He had earned well and bought properties in his name at Vilankurichi. Shanmugasundaram had partitioned the properties and gave it to his three sons S Palanisamy, 55, S Boopathy, 53 and S Selvaraj, 51 in 2006 on the condition that each of them pay him 10,000 to meet medical and other expenses.

Palanisamy works in a mechanical shop. Boopathy owns a commercial complex and sells water through tankers. Selvaraj owns a business supplying drinking water to residents.

"The trio paid their father the said amount only for the first two months. Thus, I filed a case on behalf of Shanmugasundaram against his three sons before the family court in 2008. His elder son Palanisamy accepted the court order, while the other two challenged it," said senior lawyer M Kanagaraj.

Boopathy claims not to have adequate money to pay his father. "But our investigation has revealed that Boopathy sold his property for several lakhs of rupees. We submitted many documents before the court," said lawyer Kanagaraj.

The family court had appointed a lawyer as court commissioner to get the details from Sivakamiyammal who was bedridden at the house. The court commissioner had collected the details from her and submitted them before the court.

Judge S Bhuvaneswari heard the arguments of both sides and ordered the three sons on Thursday to provide 21,000 (each 7,000) per month within the first 10 days of every month to their father.

The court also ordered that the trio should pay 2.52lakh for each year between 2008 and 2015 to their father.
